These Terms and Conditions govern your use of all services provided by Brix Super Group Pty Ltd trading as HotLister ("HotLister", "we", "our", or "us") through the hotLister platform at www.hotlister.com.au.
By accessing or using any HotLister service, you agree to be bound by these terms. If you do not agree, you must not use the platform.
You must be at least 18 years of age to use any HotLister service. By creating an account, you confirm that you are 18 years or older and that the information you provide is true and accurate.
To access certain services, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
HotLister may require identity verification before activating certain services. This may include uploading a valid photo ID (such as a drivers licence or passport). Your listing or membership will remain in a pending state until verification is completed. HotLister reserves the right to reject any account that cannot be verified.
You must not use the platform to:
HotLister reserves the right to suspend or terminate any account at any time, without prior notice, if we believe you have breached these terms, engaged in fraudulent activity, or brought the platform into disrepute. HotLister may also report suspected fraudulent activity to relevant state or territory consumer protection authorities or law enforcement.
The Seller Membership allows individuals and licensed real estate agents to list residential properties for sale on the HotLister platform.
The Seller Membership is free. Listing a property on HotLister carries no listing fee, no advertising fee, and no charge to keep your listing live, regardless of how many properties you list.
HotLister may introduce optional paid upgrades (such as featured placement) in the future. Any such upgrades will always be clearly marked as optional, and standard listings will remain free. HotLister reserves the right to modify the pricing of any future optional upgrades with a minimum of 30 days written notice.
You warrant and represent that you are either: (a) the registered legal owner of the property, or (b) a person who has been expressly authorised by the registered legal owner to advertise the property for sale, or (c) a licensed real estate agent with a valid and current agency agreement or authority to sell the property.
Listing a property without authority may constitute fraud under applicable state and Commonwealth criminal law and may result in criminal prosecution, civil penalties, and immediate account termination.
You confirm that all information provided in your listing is true, accurate, complete, and not misleading. This includes the property address, price, features, photographs, descriptions, and your contact details.
Property advertising in Australia is governed by the Australian Consumer Law (ACL), specifically Section 18, which prohibits conduct in trade or commerce that is misleading or deceptive, or is likely to mislead or deceive. This applies to all property listings regardless of whether the seller is a licensed agent or a private individual.
Penalties for misleading or deceptive conduct are severe. Under the ACL, individuals face fines of up to $2.5 million and corporations face fines of up to $50 million, three times the benefit obtained, or 30% of adjusted turnover — whichever is greater. State-based legislation may impose additional penalties.
By listing on HotLister, you acknowledge that you are solely responsible for ensuring your listing complies with all applicable Commonwealth, state, and territory legislation.
All photographs must be of the actual property being listed and must accurately represent the property's current condition. The following are strictly prohibited:
Claims about development potential must include "subject to council/planning approval" where applicable. Claims about rental returns or investment performance must be based on verifiable data.
If you are a licensed real estate agent, you confirm that: (a) you hold a valid and current real estate licence or certificate of registration in the state or territory in which you operate, (b) you are authorised under the terms of your licence to advertise the property, (c) you will comply with all state and territory property legislation including but not limited to the Property and Stock Agents Act 2002 (NSW), the Estate Agents Act 1980 (VIC), the Property Occupations Act 2014 (QLD), and equivalent legislation in your jurisdiction.
HotLister reserves the right to verify your licence against public state and territory registers at any time. Providing a false, expired, or invalid licence number will result in immediate removal of all your listings and permanent suspension of your account.
Selling a property in Australia requires a legally prepared Contract of Sale. The requirements for this contract vary from state to state. It is your responsibility as the seller to engage a qualified solicitor or conveyancer to prepare and review all sale contracts before exchanging with a buyer. HotLister does not provide legal services and does not prepare contracts.
Your contact details (name, email, and phone number) will be displayed on your listing so that buyers can contact you directly. By listing, you consent to this information being publicly visible on the HotLister platform.
You may remove your listing at any time through your account dashboard. HotLister reserves the right to immediately remove any listing and suspend or terminate any account that: (a) breaches these terms, (b) is reported by users or third parties, (c) is suspected of being fraudulent, misleading, or unlawful, (d) brings HotLister into disrepute — without prior notice and without liability to you.
When creating a listing, you may select feature tags (e.g. pool, water views, double garage) and create custom tags. These tags are used to help buyers find properties through the platform's search filters. You are responsible for ensuring all selected tags accurately represent the property. Selecting tags that do not apply to the property constitutes misleading conduct.
The HotLister Membership provides subscribers with access to property tools, research resources, exclusive property opportunities, and general property information sourced through a network of real estate agents, developers and industry contacts across Australia.
New members are eligible for a free trial period of three (3) days from the date of sign up. During the trial period, members receive full access to all membership tools and features at no cost.
At the end of the trial period, access to premium tools and features will be locked. Members may continue to browse free marketplace listings. To regain full access, members must subscribe to the paid membership.
One free trial is available per person. Phone number verification via SMS is required to activate a trial. Each phone number may only be used for one trial.
The HotLister Membership is priced at $14 per week, billed monthly at $56 per calendar month, automatically charged through the payment method provided at the time of subscription. The first monthly payment is processed at the end of the free trial period (or upon subscription if no trial applies), and subsequent payments are processed on the same day each month thereafter.
Payment is not required during the free trial period. Subscription and payment are only activated when the member chooses to subscribe after their trial has ended.
Your membership will remain active until cancelled in accordance with the cancellation policy outlined below.
All paid memberships are subject to a minimum membership period of one (1) calendar month — equivalent to four (4) weeks at $14 per week, totalling $56 — from the date of first paid subscription (not the trial start date). Members cannot cancel within the first month and the full $56 monthly payment will be charged regardless. After the initial month, members may cancel at any time and cancellation will take effect at the end of the current paid month.
Members may cancel their subscription at any time after the initial one (1) month minimum membership period. Cancellation takes effect at the end of the current billing cycle, meaning members retain full access until the next billing date and will not be charged again. Any payments already processed are non-refundable. Members may cancel their subscription through the membership portal or by contacting HotLister.
HotLister will send email and SMS notifications to members before and after their trial period expires. These notifications will include a link to subscribe to the paid membership. By providing your phone number and email at sign up, you consent to receiving these communications.
The Discover Membership provides a property opportunity introduction service only. Under this membership, HotLister does not act as a buyers agent for subscribers and does not provide buyers agency services including but not limited to:
Subscribers remain solely responsible for conducting their own investigations and making their own decisions in relation to any property opportunity presented.
Subscribers are strongly encouraged to obtain independent financial, legal and tax advice before entering into any property transaction.
HotLister does not guarantee the performance, suitability or investment outcome of any property opportunity shared with members.
Property opportunities shared through the membership are provided for informational and introduction purposes only. The service is intended to introduce subscribers to potential unique property opportunities that may be available through third-party real estate agents, developers or property professionals.
Subscribers who wish to pursue any opportunity must deal directly with the relevant selling agent or property representative.
In some circumstances, HotLister or a related entity may act as the listing agent for a property presented through the membership platform. Where this occurs, it will be clearly disclosed within the property details. In these circumstances, HotLister acts on behalf of the vendor and may receive commission or fees from the vendor. HotLister does not act as a buyers agent for subscribers in these transactions.
Property information provided through the membership is often sourced from third-party real estate agents, developers or industry contacts. While reasonable care may be taken when sharing this information, HotLister does not warrant the accuracy, completeness or currency of the information provided. Property details, pricing, availability and other information may change at any time without notice.
Property opportunities provided to members are subject to availability and may be withdrawn, altered or sold at any time without notice. HotLister does not guarantee the availability of any property opportunity shared with members.
All property opportunities, information, summaries and materials provided through the membership service are intended for the personal use of the subscriber only. Members must not copy, distribute, reproduce, share, publish or provide access to membership content to any third party without prior written consent from HotLister.
This includes but is not limited to: posting property opportunities on social media platforms, sharing opportunities within online forums or messaging groups, forwarding property information to non-members, or republishing deal summaries or opportunity details.
HotLister reserves the right to suspend or terminate membership immediately without refund if a subscriber is found to have shared or distributed confidential membership content without permission.
Subscribers agree that they will not intentionally circumvent, bypass or undermine the role of HotLister by using information obtained through the membership platform to directly approach property owners, developers, agents or other industry contacts introduced through the platform for the purpose of avoiding the involvement of HotLister in circumstances where the company has a disclosed role in the transaction.
The Engage service connects buyers with professional buyers agents who can assist with property search, evaluation, negotiation and acquisition.
At present, the Engage service is provided directly by HotLister's buyers agents who operate across Australia. In the future, the Engage service may also connect buyers with independent third-party buyers agents in specific local markets.
Where HotLister acts as the buyers agent, a separate engagement agreement will be provided outlining the specific scope of services, fees, and obligations for both parties. The Engage service is a capacity-limited, hands-on service. HotLister reserves the right to conduct an initial assessment to determine suitability before accepting an engagement.
Buyers agent fees vary depending on the agent, the scope of the engagement, and the level of service provided. Fee structures generally include an upfront engagement fee and a percentage fee payable at settlement, however this may vary between agents and service levels.
All fees will be clearly outlined in a separate buyers agent engagement agreement provided before any work commences. No fees are charged without a signed engagement agreement. For full details on fees, please refer to the buyers agent engagement agreement provided to you during the onboarding process.
Clients engaging a buyers agent through HotLister are still encouraged to obtain independent financial, legal and tax advice. The buyers agent service does not replace the need for independent professional advice on matters including finance, tax, legal, building inspections, or pest inspections.
The Property Investment Analysis (PIA) tool and all financial projection features provided through the HotLister platform are for general informational and educational purposes only. All cashflow projections, capital growth estimates, rental yield calculations, and investment scenarios generated by the PIA tool are estimates only and are not guaranteed.
The PIA tool does not constitute financial advice, investment advice, or a recommendation to purchase any property. Results are based on assumptions and inputs provided by the user and may not reflect actual market conditions, future performance, or individual circumstances.
HotLister strongly recommends that users obtain independent financial, legal, and tax advice from appropriately licensed professionals before making any property investment decision. HotLister accepts no liability for any loss, damage, or financial outcome arising from reliance on PIA tool outputs.
Suburb report cards, market data, median prices, growth rates, rental yields, vacancy rates, the hotLister Score, and all statistical information provided through the platform are sourced from third-party data providers and publicly available sources. While reasonable care is taken in presenting this data, HotLister does not warrant the accuracy, completeness, timeliness, or reliability of any data provided.
Data may be delayed, incomplete, contain errors, or not reflect current market conditions. Historical performance data does not guarantee future results. The hotLister Score is a proprietary rating based on available data points and should be used as a general guide only — not as the sole basis for any investment decision.
HotLister accepts no liability for any decisions made based on data provided through suburb report cards, comparison tools, budget maps, or any other data-driven feature on the platform.
The Market Watch feature provides automated alerts based on user-defined criteria. HotLister does not guarantee that all matching properties will be captured by alerts, that alerts will be delivered in real time, or that property information in alerts is accurate or current. Properties may be sold, withdrawn, or changed before an alert is received.
The AI description writer and AI social media post generator produce content suggestions using automated systems. All AI-generated content is provided as a draft for the user to review, edit, and approve before use.
Users are solely responsible for reviewing and ensuring the accuracy and compliance of any AI-generated content before publishing it on the platform or sharing it on social media. HotLister accepts no liability for any claims, losses, or penalties arising from the use of AI-generated content that is published without adequate review by the user.
The HotLister platform is provided on an "as is" and "as available" basis. HotLister does not guarantee uninterrupted, error-free, or secure access to the platform at all times. The platform may experience downtime, outages, bugs, glitches, data delays, or technical issues from time to time.
HotLister will make reasonable efforts to maintain platform availability and resolve technical issues promptly. However, no refunds, credits, or compensation will be provided for any period of downtime, service interruption, data loss, or technical malfunction.
HotLister is not liable for any loss, damage, or missed opportunity arising from platform unavailability or technical issues.
Some data and information provided through the platform may be sourced through automated collection from publicly available sources. While HotLister endeavours to provide accurate and up-to-date information, data sourced from third parties or public sources may contain errors, omissions, or inaccuracies.
HotLister does not independently verify all third-party data and accepts no liability for the accuracy or reliability of information obtained from external sources.
The social media image creator, AI post generator, and QR code tools generate content for use on third-party platforms including but not limited to Facebook, Instagram, and other social media services. Content shared on third-party platforms is subject to the terms of service and policies of those platforms.
HotLister is not responsible for how third-party platforms display, distribute, or moderate content shared using HotLister's tools. Users are responsible for ensuring that any content they share complies with the relevant platform's terms of service.
Membership fees and listing fees are non-refundable in cases of platform downtime, technical errors, data inaccuracies, AI tool errors, or any other technical issue. By subscribing, you acknowledge that the platform is under active development and that features may change, be added, or be temporarily unavailable.
All content on the HotLister platform, including text, graphics, branding, logos, software and materials, is the property of Brix Super Group Pty Ltd unless otherwise stated. Content may not be reproduced, distributed or used without written permission.
Sellers retain ownership of the content they upload to their listings (photos, descriptions, etc.). By listing on HotLister, sellers grant HotLister a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute listing content for the purpose of operating the platform and promoting listings, including on social media and partner sites. This licence ends when the listing is removed.
You agree to indemnify, defend, and hold harmless HotLister, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to: (a) your listing content or use of the platform, (b) your breach of these terms, (c) your breach of any applicable law, (d) any dispute between you and a buyer, seller, or any third party, (e) any claim that your listing or content is false, misleading, or infringes on any third party's rights.
HotLister is a property listing and services platform. HotLister does not act as a real estate agent, broker, valuer, conveyancer, or legal advisor (except where explicitly engaged as a buyers agent under a separate agreement). HotLister makes no representations or warranties regarding the accuracy, completeness, or reliability of any listing on the platform.
HotLister is not a party to any transaction between buyers and sellers conducted through the marketplace and accepts no responsibility for any transactions, negotiations, disputes, or outcomes arising from the use of the platform.
Users are strongly encouraged to obtain independent legal, financial, and building advice before entering into any property transaction.
To the maximum extent permitted by law, HotLister's total liability to you for any claim arising out of or in connection with these terms or your use of the platform is limited to the total fees paid by you to HotLister in the 12 months preceding the claim.
HotLister may update these terms from time to time. Material changes will be notified via email or through the platform. Continued use of the platform after changes are published constitutes acceptance of the updated terms. If you do not agree with any changes, you must cease using the platform and cancel your memberships.
These terms are governed by the laws of the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of Australia for the resolution of any disputes.
By using any HotLister service, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
